In March 2015, the Advertising Standards Council of India's Consumer Complaints Council upheld complaints against 185 out of 230 advertisements

asci-logoIn March 2015, the Advertising Standards Council of India's (ASCI) Consumer Complaints Council (CCC) upheld complaints against 185 out of 230 advertisements. Out of 185 advertisements against which complaints were upheld, 81 belonged to the Personal and Healthcare category, followed by 57 advertisements in the Education category, and 47 advertisements in other categories.

Health and Personal Care:

The CCC found claims in 81 health and personal care product or service advertisements to be either misleading or false or not adequately/ scientifically substantiated and hence, violating ASCI's Code. Some of the health care products or services advertisements also contravened provisions of the Drug & Magic Remedies Act and Chapter 1.1 and III.4 of the ASCI Code. Among these were ads of Wipro Enterprises' Santoor Hand Wash, Deys Medical's Keo Karpin Hair Oil, L'Oreal India's Absolut Repair Lipidium and Garnier Men's Oil Clear Face Wash, Marico's Parachute Advanced Coconut Hair Oil and Hair & Care, Hindustan Unilever's Dove Intense Repair Therapy Shampoo.

TV Today Network (Headlines Today): The advertisement's claim, “News Today at nine beats the Newshour four out of five days”, was found to be misleading. Times Television Network (Movies Now): The advertisement of the channel claims to be No. 1 English movie channel consistently, which is not substantiated. This claim quoting TAM source violated the TAM Guidelines. The period of comparison is too short and thereby confers an artificial advantage upon the advertiser.

Madhyamam Broadcasting (MediaOne TV): The advertisement of the channel claims to occupy the urban sky, which was misleading. The claim quoting TAM sources violated the TAM guidelines. The period of comparison is too short and thereby confers an artificial advantage upon the advertiser.

The Sandesh (Sandesh Samachar): The channel claims to be first choice of every Gujarati - Sandesh News No. 1. Also, the channel claims to leave behind ratings of the national news channels, which is a misleading claim. This claim quoting TAM sources violated the TAM Guidelines. The period of comparison is too short and thereby confers an artificial advantage of the advertiser.

Mathrubhumi Printing & Publishing: The advertisement of the channel claims to be No. 2 amongst other Malayalam news channels, which is not substantiated and is misleading. This claim quoting TAM source violated the TAM Guidelines. The period of comparison is too short and thereby confers an artificial advantage upon the advertiser.

Malayala Manorama (MMN Manorama News): The advertisement of the channel claims that it is Kerala's No. 1 news channel and the news they telecast is better than that of Asianet, Mathrubhumi News, Reporter and People. This claim quoting TAM source violated the TAM Guidelines. The period of comparison is too short and thereby confers an artificial advantage upon the advertiser.

The Sandesh (Sandesh Samachar): The channel's claims to be No. 1, which is unsubstantiated by TAM ratings, are false and misleading. These claims quoting TAM source violated the TAM Guidelines. The period of comparison is too short and thereby confers an artificial advantage upon the advertiser.

INX News: The advertisement claims News X to be India's No. 1 English news channel, which is false and misleading as the source quoted for this claim of TAM ratings violated the TAM Guidelines. The period of comparison is too short and thereby confers an artificial advantage upon the advertiser.

E-commerce & Teleshopping:

The claims of the following ads were found to be misleading or unsubstantiated and the complaints were upheld: Telebrands India (Wax Vac) - shows a dangerous act; Naaptol Online Shopping (Aluminium Secure Wallet); Trendsutra Platform Services (Pepperfry.com); India Webportal (India.com); and Pisces Eservices (Foodpanda.in).

Food & Beverages:

Among the ads against which complaints were upheld included Cremica Agro Food Products (Cremica Biscuits), GlaxoSmithKline Healthcare Ltd (Horlicks and Junior Horlicks), and Parle Products (Parle G Biscuits).

Education:

The CCC found claims in advertisements by 57 advertisers that were not substantiated and, thus, violated ASCI Guidelines for Advertising of Educational Institutions. Hence complaints against these advertisements were upheld.

Others:

The claims in the ads of following brands were found to be misleading or unsubstantiated and the complaints were upheld: Meenakshi Constructions (Jewel Meadows); Godrej Consumer Products (Goodknight Active Plus); Ralson India (Ralco Tyres) - promotes an unsafe practice; Lodha Developers (Lodha Splendora); The Park Hotels; SpiceJet – false claim; Diamond Enterprises (Puncture Lock); Fena (Nip Active Dish Wash Bar); Bharti Airtel (Airtel My Plan); Ambuja Neotia (Raichak on Ganges) – false claim; Vidhilikhit Bhavishya; Dwarkadhis Projects (Casa Romana); Honda Motorcycle & Scooter India (Honda); 3M India (Scotch Brite); Kent Ro System (Kent Water Purifier); Tata Motors (Tata ACE CNG); Ma DhanLaxmi Yantra; Hindustan Unilever (Surf Excel Matic).
